1. ACCEPTANCE OF THESE TERMS AND CONDITIONS

Zapout, a company registered in Sweden, operates the Zapout platform and mobile application ("Services"). By accessing or using the Services, you acknowledge and agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you are not permitted to use the Services and must immediately discontinue use.

Zapout reserves the right to amend these Terms. Changes take effect upon publication on our website at www.Zapout.se. When updating Terms, Zapout will notify users via email or in-app notification. Continued use of the Services after amendments constitutes acceptance of the revised Terms.

2. PRE-CONTRACTUAL INFORMATION AND TRANSPARENCY

Before entering into any paid subscription or service, you will receive clear information about:

• Payment terms: Fees are clearly stated in the pricing model within the platform or communicated directly to you.
• Contract duration: Monthly subscription or pay-per-use options based on your preference.
• Delivery: You receive instant access upon payment confirmation.
• Termination rights: As detailed in Section 17 below.
• Functionality: Complete service description available within the app and www.Zapout.se.
• Technical requirements: BankID authentication, compatible devices and internet access.
• Technical protection measures: Encryption and security protocols.
• Compatibility and interoperability: Supported operating systems and browsers.
• Customer support: You can reach us at support@Zapout.se or through our in-app support form.

3. AGE RESTRICTION

To subscribe to the Services, you must be at least 18 years old. If you are under 18, you may only use the Services and enter into a subscription with the explicit consent of your parent or legal guardian. By using the Services, you confirm that you meet this age requirement or have obtained the necessary consent.

4. FEES AND PAYMENT

Zapout charges fees for its services according to the price list available on our website. All prices are stated including VAT where applicable. For one-time services, payment is charged immediately when you use the service, while the subscription fee is charged at the end of each calendar month.

If payment cannot be processed, you will be immediately notified by email and given the opportunity to update your payment information. If payment issues continue, your account may be temporarily suspended until payment has been received. Zapout reserves the right to take legal action to collect outstanding payments in accordance with Swedish law.

5. RIGHT OF WITHDRAWAL (ÅNGERRÄTT)

You have 14 days to change your mind about your purchase, in accordance with Swedish consumer law. If you would like to cancel your purchase you can use the app's cancellation feature or contact support@Zapout.se. Refunds are processed within 14 days using your original payment method.

IMPORTANT: You lose your right to cancel once you submit your first compensation application. This is because our service is then considered fully performed. When you submit an application, you:

• Become bound by your purchase
• Cannot get a refund for that service
• Waive your 14-day cancellation right

For the avoidance of doubt: You can cancel within 14 days, but once you submit your first compensation application, the service is complete and no refunds are available for that one application or that subscription period.

Free trials: If you start with a free trial that becomes paid, you won't get a new 14-day cancellation period when billing starts.

Subscriptions: Unless you cancel before your next billing date, you agree to pay for the next period. We don't provide refunds for unused portions of subscription periods.

6. COMPLAINT HANDLING

You may submit complaints regarding the Services by contacting support@Zapout.se or via the in-app support form. Zapout will respond within 14 days and seek to resolve complaints promptly. For unresolved disputes, you may contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden - ARN) for alternative dispute resolution.

7. PROHIBITED CONDUCT AND PLATFORM MISUSE

You agree to use the Services ethically and lawfully. Prohibited actions include, but are not limited to:

• Providing false or misleading information
• Submitting fraudulent compensation claims
• Attempting to manipulate our platform or systems
• Infringing third-party rights
• Using automated tools without permission from Zapout
• Circumventing security features

Zapout reserves the right to immediately terminate access, report behavior to legal authorities, and initiate legal action in cases of misconduct, abuse, or malicious behavior.

8. USER RESPONSIBILITY FOR CONTENT

You are solely responsible for any content you upload or submit via the platform. You retain rights to content you upload (e.g., receipts), but grant Zapout a license to use such content for service provision. Zapout is not liable for any claims, damages, or losses arising out of user-generated content. Zapout reserves the right, but not the obligation, to monitor and remove any content that violates these Terms or applicable laws.

By using the Services, you represent and warrant that all registration information you submit will be true, accurate, current, and complete. Providing false information may result in suspension or termination of your account and potential legal liability.

9. FUNCTIONALITY AND SECURITY

The Services require:

• A compatible device (smartphone or computer)
• Internet access
• BankID for authentication

Zapout is not responsible for incompatibility with unsupported devices or browsers. User data is protected through encryption and secure storage protocols. We regularly update our security measures to maintain high protection standards.

10. INTELLECTUAL PROPERTY

All intellectual property, including but not limited to content, designs, software, and branding, belongs exclusively to Zapout or its licensors. The content and marks are protected by copyright and trademark laws and are provided "as is" for your personal, non-commercial use only. No part of the Services may be copied, distributed, or reproduced without explicit written permission from Zapout.

11. GDPR COMPLIANCE AND DATA PRIVACY

Zapout is committed to protecting your privacy and handling your data in compliance with the General Data Protection Regulation (GDPR):

• Purpose of Data Processing: Personal data is collected and processed solely for delivering and improving the Services.
• Legal Basis: Processing is based on contract performance, legitimate interests, or explicit consent where required.
• Data Subject Rights: You may request access, correction, deletion, or portability of personal data.
• Consent: Where required, consent must be freely given, specific, informed, and unambiguous. You may withdraw consent at any time.
• Storage and Security: Zapout employs reasonable security measures to protect your data.
• Data Controller: Zapout acts as data controller for personal data processing.

You can request access to data generated by your account, including travel history, uploaded receipts, and personal information. Limitations or exceptions (e.g., legal retention requirements) are specified in our Privacy Policy which is available on our website, www.Zapout.se.

12. AUTOMATED DECISION-MAKING AND AI

Certain features of the Services may use automated decision-making (AI) to process compensation applications or other service features. When automated decision-making significantly affects your rights:

• You will be informed that automated processing is being used.
• You have the right to request human review of any automated decision.
• You may contest the decision and request manual processing.
• You will be provided with meaningful information about the logic involved.

13. COMMUNICATIONS

By using the Services, you agree to receive communications electronically, including emails, push notifications, legal notices, invoices, and updates. Electronic communications satisfy any legal requirement for written communication.

14. DISCLAIMER OF WARRANTIES

The Services are provided on an "as is" and "as available" basis. Zapout makes no warranties, express or implied, including but not limited to accuracy, completeness, reliability, or availability, except as required by mandatory consumer protection laws.

15. LIMITATION OF LIABILITY

To the extent permitted by law, Zapout shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use the Services, except for damages caused by gross negligence or intentional misconduct. This limitation does not affect your statutory rights as a consumer.

16. INDEMNIFICATION

You are responsible for using our Services lawfully and providing accurate information. If you intentionally submit fraudulent claims or deliberately misuse our platform in a way that causes direct financial harm to Zapout or third parties, you may be liable for such damages under Swedish law.

This liability is limited to direct damages actually caused by your intentional misconduct and does not affect your statutory consumer rights under Swedish law.

17. TERMINATION AND CANCELLATION

You may terminate your account at any time. Upon termination, premium subscriptions end at the current billing period, and your data remains available for 30 days for retrieval. All user-generated content handling follows our data retention policy. You may not re-register under another identity if your account was terminated for breach of these Terms.

18. GENERAL CONSUMER PROTECTION

Nothing in these Terms shall limit your statutory rights as a consumer under Swedish law. Any waiver of consumer rights, including the right of withdrawal, is only valid to the extent permitted by mandatory law. Any terms that seek to limit your rights beyond what is allowed by law shall be deemed invalid.

19. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of Sweden. All disputes shall be resolved exclusively in the courts of Stockholm, Sweden, and you agree to submit to their jurisdiction. You may also contact the Swedish National Board for Consumer Disputes (ARN) for alternative dispute resolution before pursuing court action.
